By using this website, requesting a service estimate, or engaging Orem Masonry & Concrete for any work, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or request our services. These terms may be updated from time to time. Orem Masonry & Concrete provides masonry contracting services to residential and commercial property owners in Orem, Utah and surrounding Utah County communities. Services include but are not limited to:
The specific scope of any individual project is defined in a written estimate provided before work begins. Services not listed in a written estimate are not included.
We provide written estimates before any work begins. An estimate is based on the conditions observed at the time of our on-site visit and represents our best assessment of the scope and cost of the project.
Estimates are not binding contracts. If unforeseen conditions are discovered during the work - such as hidden structural damage, unexpected soil conditions, or materials that differ from what was visible during the estimate visit - we will notify you of any change in scope and cost before proceeding with additional work.
Prices quoted are valid for 30 days from the date of the estimate unless otherwise stated in writing. Material price fluctuations after that period may require a revised estimate.
Project start dates are confirmed in writing at the time of agreement. Weather conditions, permit processing times, and prior project delays may affect scheduling. We will communicate any changes to your scheduled start date as soon as they are known.
If you need to cancel or reschedule a project, please notify us as soon as possible. Cancellations made after materials have been ordered may result in a restocking or materials fee. The specific terms of any deposit or cancellation fee will be stated in your written estimate.
We reserve the right to reschedule work due to severe weather, supply chain delays, or circumstances outside our control. We will not be liable for delays caused by factors beyond our reasonable control.
Payment terms are outlined in each written estimate and may include a deposit required before work begins, with the balance due upon project completion. Accepted payment methods will be specified in your estimate.
Payment is due within the timeframe stated in the estimate. Invoices not paid within 30 days of the due date may be subject to a late fee. If an account remains unpaid, we reserve the right to pursue collection through appropriate legal means, including the filing of a mechanics lien on the property in accordance with Utah law.
Disputes over an invoice must be raised in writing within 10 days of receipt. Undisputed portions of an invoice remain due and payable on their original due date.
For projects that require a building permit under Orem City or Utah County requirements, we will obtain the necessary permits before structural work begins. Permit fees will be included in or added to the project estimate.
You are responsible for ensuring that the project complies with any homeowners association (HOA) rules or deed restrictions that apply to your property. We are not responsible for HOA violations that result from work you have authorized.

We stand behind the quality of our work. Any specific warranty terms applicable to your project will be provided in writing at the time of project completion. Warranty coverage, if offered, applies to workmanship defects under normal use and does not cover damage resulting from:
Manufacturer warranties on materials are passed through to you where available and are governed by the terms of the respective manufacturer. We make no additional warranty representations on third-party materials beyond what the manufacturer provides.
To the fullest extent permitted by law, Orem Masonry & Concrete shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services or your use of this website, including but not limited to loss of income, loss of use, or property damage not directly caused by our negligence.
Our total liability for any claim arising out of a project shall not exceed the total amount paid by you for that project. Nothing in these terms limits liability for gross negligence, intentional misconduct, or personal injury caused by our actions.

The arbitrator's decision will be final and binding, and may be entered as a judgment in any court of competent jurisdiction.
You agree that any dispute will be brought in your individual capacity only, not as a class action or representative proceeding.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the courts of Utah County, Utah.
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective upon posting to this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms.
